This Privacy Policy explains how ScentRX, Inc. (“ScentRX”, “we”, “us” or “our”), a Texas corporation, collects, uses and shares information when you use the ScentRX mobile apps, the ScentRX web app and the website at scent-rx.com (together, the “Services”). By using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services.
The Services are offered to people in the United States only.
1. Information we collect
Information you give us
- Account information: your email address or phone number, name or username, and profile photo if you add one. We use a one-time passcode to sign you in, so we do not collect or store a password.
- Sign-in with Google, Apple or Facebook: if you choose one of these options, we receive basic profile information that the provider shares with your permission, such as your name, email address and profile picture.
- Your fragrance content: the fragrances you add to your Virtual Scent Shelf and Wishlist, RX Cards you create (layering recipes, product picks, application instructions, vibe labels, captions, images and links), and cards you save, copy or share.
- Prompts and preferences: the moods, occasions and preferences you describe to RX Builder when you ask for a blend.
- Messages to us: anything you send when you contact support or give feedback.
Information collected automatically
- Usage information: the features you use, pages and cards you view, searches, clicks, and the date and time of your activity.
- Device information: device type, operating system, app version, browser type, language, IP address and general location derived from your IP address (such as city or state). We do not collect precise GPS location.
- Cookies and similar technologies: our website and web app use cookies and local storage to keep you signed in, remember your settings, and understand how the Services are used. You can control cookies in your browser settings, but some features may not work without them.
Information from others
- App stores: if you buy a subscription or start a free trial, Apple or Google processes the payment and tells us your subscription status. We do not receive or store your full card details.
- Retail and affiliate partners: when you tap a shopping link, a partner may tell us that a click or purchase happened so we can earn a commission. This information does not usually identify you by name.
2. How we use your information
- To create and manage your account and sign you in.
- To provide the Services, including your Scent Shelf, Wishlist, RX Cards, RX Feed and Discover.
- To generate AI layering recommendations with RX Builder.
- To show you shoppable links and earn affiliate commissions.
- To process subscriptions and free trials through the app stores.
- To personalize what you see, such as suggested blends and cards.
- To send you service messages such as passcodes, account notices and changes to our terms. With your permission, we may also send product updates or marketing, which you can turn off at any time.
- To keep the Services safe, prevent fraud and abuse, and enforce our Terms of Service.
- To understand how the Services are used and to improve them.
- To comply with the law.
3. AI features
RX Builder uses artificial intelligence to suggest fragrance blends. To do this, we send the relevant parts of your request and your shelf (for example, the fragrances you own and the mood you describe) to our AI provider, OpenAI, which processes them on our behalf to generate a response. We do not send your name, email address or phone number with these requests. AI suggestions can be wrong or unsuitable, so please use your own judgment, especially if you have sensitivities to certain ingredients.
4. How we share information
We do not sell your personal information for money. We share information only as described here:
- Other users and the public: RX Cards and profile information you choose to make public can be seen, saved, copied and shared by other people, inside and outside the Services.
- When you share: if you share an RX Card to Instagram, TikTok or another platform, that platform’s own privacy policy applies to what you post there.
- Service providers: companies that help us run the Services, such as hosting, databases, email and SMS delivery, analytics, customer support and AI processing (including OpenAI). They may use your information only to provide services to us.
- Sign-in providers and app stores: Google, Apple and Facebook when you use them to sign in, and Apple and Google to process subscriptions.
- Retail and affiliate partners: limited information about clicks and purchases made through our shopping links.
- Legal and safety reasons: when we believe it is required by law, or needed to protect the rights, property or safety of ScentRX, our users or others.
- Business transfers: if we are involved in a merger, acquisition, financing or sale of assets, your information may be transferred as part of that deal.
- With your consent: in any other case where you ask us to or agree to it.
Some sharing for advertising or affiliate measurement may count as “selling” or “sharing” under certain state privacy laws. You can opt out of this at any time by emailing us (see Section 7).
5. How long we keep information
We keep your information for as long as your account is active and as needed to provide the Services. If you delete your account, we delete or de-identify your personal information within a reasonable time, except where we need to keep it to meet legal obligations, resolve disputes or enforce our agreements. RX Cards that other users have already copied to their own accounts may remain in those accounts.
6. Security
We use reasonable technical and organizational measures to protect your information, such as encryption in transit and access controls. No method of storing or sending data is completely secure, so we cannot guarantee absolute security.
7. Your choices and rights
- Account and content: you can view and edit your profile, shelf, Wishlist and RX Cards in the app, and change whether your cards are public.
- Delete your account: you can delete your account in the app settings or by emailing us.
- Marketing: you can unsubscribe from marketing emails using the link in the email, and turn off push notifications in your device settings.
- Cookies: you can block or delete cookies in your browser settings.
Depending on the state you live in (for example California, Texas, Colorado, Virginia or Connecticut), you may have the right to:
- know what personal information we have about you and get a copy of it;
- correct information that is inaccurate;
- delete your personal information;
- opt out of the sale or sharing of personal information, targeted advertising and profiling; and
- appeal our decision if we deny your request.
To make a request, email team@scent-rx.com. We will need to confirm your identity before we act on it, and you may use an authorized agent where the law allows. We will not treat you differently for exercising your rights.
8. Children
The Services are not meant for children under 13, and we do not knowingly collect personal information from them. If you are under 18, you may use the Services only with the involvement of a parent or guardian. If you believe a child under 13 has given us personal information, please contact us and we will delete it.
9. Links to other sites
The Services link to retailers and other websites that we do not control. Their privacy practices are governed by their own policies, and we are not responsible for them.
10. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will change the effective date above, and if the changes are significant we will let you know in the app or by email before they take effect.
